By creating an account or using the Service, you affirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
AgentFuse provides a B2B API middleware that enables developers to embed affiliate program capabilities into their own applications. The Service includes:
You will be issued API keys to authenticate your requests. You are solely responsible for maintaining the confidentiality of your API keys and for all activity that occurs under your account. You must immediately notify us at hello@agentfuse.io of any unauthorized use of your API keys or any other breach of security. We are not liable for any loss resulting from unauthorized use of your credentials.
You agree not to use the Service to:
Your subscription plan includes defined API rate limits. Exceeding these limits may result in throttled responses or temporary suspension of your access. We reserve the right to adjust rate limits to ensure quality of service for all customers.
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as expressly set forth in these Terms. We reserve the right to change pricing with at least 30 days' notice. Failure to pay may result in suspension or termination of your account.
The Service, including all software, APIs, documentation, and content, is owned by AgentFuse and protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference. You are responsible for ensuring your own use of the Service complies with applicable data protection laws, including obtaining any necessary consents from your end users.
The Service integrates with third-party affiliate networks (e.g., PartnerStack, Impact.com). These networks have their own terms and conditions. AgentFuse is not responsible for the acts or omissions of any third-party affiliate network, including changes to commission rates, program terms, or payment policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OD AGY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, AGENTFUSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless AgentFuse and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, all licenses granted to you will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by the laws of the United States and the state in which AgentFuse is registered, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the courts of competent jurisdiction in that state.
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
